Box 520 <br />Pleasanton CA 94566 <br /> <br /> CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 93-99 <br /> <br /> RESOLUTION VACATIN~ THE TEMPORARY STORM DRAIN <br /> EASEMENT LOCATED AT SUNOL BOULEVARD AND <br /> MISSION DRIVE <br /> <br />WHEREAS, in 1988, a portion of Sunol Boulevard was reconstructed <br /> and widened and a temporary storm drain easement was <br /> created until the permanent utilities were constructed; <br /> and <br /> <br />WHEREAS, construction has been completed and the temporary storm <br /> drain easement is no longer required; and <br /> <br />WHEREAS, at its meeting of August 3, 1993, the City Council <br /> received a staff report (SR 93:323) recommending vacation <br /> of the temporary storm drain easement. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Pursuant to Chapter 4 of the Streets and Highways Code <br /> and based upon the findings above establishing that the <br /> temporary storm drain easement is no longer necessary due <br /> to relocation of the permanent facility pursuant to <br /> Section 8333 of the Streets and Highways Code, the <br /> temporary storm drain easement described in Exhibit "A" <br /> is hereby vacated. <br /> <br />Section 2: The City Clerk shall cause a certified copy of this <br /> resolution of vacation to be recorded in the Office of <br /> the Alameda County Recorder. <br /> <br />Section 3: That from and after the date the resolution is <br /> recorded, the temporary storm drain easement vacated no <br /> longer constitutes a public service easement. <br /> <br /> <br />
