<br />Honorable Mayor and Members of the City Council: <br /> <br />BACKGROUND <br /> <br />Tract 7399 is a single-family residential subdivision proposed by Berlogar Vineyard Inc. The <br />site (Parcell of Parcel Map 8070), is located on the south side of the Old Vineyard (Avenue) <br />trail and easterly of Pietronave Lane, as shown on attached vicinity map. <br /> <br />In addition to 9 single family detached custom residential lots, Tract 7399 also creates a Parcel <br />"A" and Parcel "B" open space. Parcel "B" will be landscaped with Oak trees and irrigated <br />with a temporary irrigation system that will be used until the trees are established. A <br />Homeowners Association will be responsible for maintaining this landscaping and irrigation <br />system as well as the natural open space on Parcel "A" (See Exhibit B). <br /> <br />On June 5, 2001, the City Council approved PUD-05, an application by Centex Homes for the <br />construction of nineteen single family detached homes within 14.9 acres designated for low <br />density residential. This approval covered two properties - the Berlogar (2200 Vineyard <br />Avenue) and Chrisman (1944 Vineyard Avenue) properties. <br /> <br />On April 2, 2002, the City Council approved Parcel Map 8070, dividing the Berlogar property <br />into two parcels to align it with the Specific Plan's land use designations of Low Density <br />Residential and Hillside Residential. <br /> <br />On September 16, 2003, the City Council approved Vesting Tentative Subdivision Tract 7399 <br />for Northstar Construction, which subdivided the Berlogar/Chrisman properties into 19 lots <br />following the lotting and circulation plan of PUD-05. <br /> <br />On August 10, 2005, the City Council approved PUD-05-1M, separating the development into <br />two phases along its ownership lines. <br /> <br />Since only the Berlogar portion of the loop street (originally designed to serve the Berlogar and <br />Chrisman properties) will be built at this time, a temporary hammerhead turnaround will be <br />constructed at the common property line between the two properties. Since the hammerhead <br />partially extends onto the Chrisman property, the Chrisman's have granted an easement to the <br />City for public street use. The easement for the temporary turnaround contains a sunset clause <br />such that the easement would terminate when the loop road is extended with the development <br />of the Chrisman property. <br /> <br />The Engineering staff, Planning staff, the City Attorney's Office and Tri-Valley Conservancy, <br />have reviewed the Final Map, Improvement Plans, and other legal documents for Tract 7399. <br /> <br />SR 06:056 <br />Page 2 of 4 <br />
