CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 93-74 <br /> <br /> RESOLUTION PERHITTING CITY OF PLF~S~ON TO <br /> JOIN IN I~MICUS BRIEF <br /> <br />WHEREAS, pending in the Ninth Circuit Court of Appeals is Ber~vv. <br /> County of Sonoma that will determine important issues <br /> concerning when overtime pursuant to the Fair Labor <br /> Standards Act must be paid to employees who are "on <br /> call"; and <br /> <br />WHEREAS, the amici curiae (friends of the court) brief is being <br /> prepared in which other cities may join at no cost; and <br /> <br />WHEREAS, the City Attorney has recommended to the City Council <br /> that the City of Pleasanton be added to the amici curiae <br /> brief, at no out-of-pocket expense to the local <br /> taxpayers. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OFPLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Council hereby approves joinder of the City <br /> of Pleasanotn in the amici curiae brief in the case of <br /> Berry v. County of Son0ma. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLYADOPTED BY THE CITY COUNCIL OFT HE CITY OF PLEASANTON, AT <br />A MEETING HELD ON JUNE 15, 1993 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Dennis, Mohr, Pico, Scribner, and Mayor <br /> Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> ATTEST: ? <br /> <br /> : <br /> <br />Michael H.
