CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 93-54 RESOLUTION UPHOLDING THE APPEAL AND DENYING WITHOUT PREJUDICE THE MODIFIED BRIDGE DESIGN WHEREAS, the Design Review Board approved Case Z-93-50, the application of The De Silva Group for approval of a new, two-lane bridge immediately south of, and adjacent to, the existing Bernal Avenue bridge, as required by the conditions of approval of PUD-89-5 and the Laquna Oaks Specific Plan; and WHEREAS, within the time specified by the Pleasanton Municipal Code, the City Council of Pleasanton appealed the decision; and WHEREAS, a public hearing was held before the City Council on May 4, 1993, at which time all pertinent testimony and documents were reviewed; and WHEREAS, the City Council finds that the proposed bridge design is not appropriately related to, or architecturally compatible with, the design ofthe existing Bernal Avenue bridge. NOW, THEREFORE, THE CITY COUNCIL OF THECITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Upholds the appeal and denies without prejudice the design for a new, two-lane bridge immediately south of, and adjacent to, the existing Bernal Avenue bridge, as required by the conditions of approval of PUD-89-5 and the Laguna Oaks Specific Plan. Section 2: Directs staff to investigate methods to finance a new steel truss bridge. Section 3: Initiates a modification to the conditions of approval of the PUD to eliminate that portion of the conditions which require the completion of the Bernal Avenue bridge prior to occupancy of the final thirty units. Section 4: This resolution shall become effective immediately upon its passage and adoption.
