CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 93-54 <br /> <br /> RESOLUTION UPHOLDING THE APPEAL AND DENYING <br /> WITHOUT PREJUDICE THE MODIFIED BRIDGE DESIGN <br /> <br />WHEREAS, the Design Review Board approved Case Z-93-50, the <br /> application of The De Silva Group for approval of a new, <br /> two-lane bridge immediately south of, and adjacent to, <br /> the existing Bernal Avenue bridge, as required by the <br /> conditions of approval of PUD-89-5 and the Laquna Oaks <br /> Specific Plan; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal <br /> Code, the City Council of Pleasanton appealed the <br /> decision; and <br /> <br />WHEREAS, a public hearing was held before the City Council on <br /> May 4, 1993, at which time all pertinent testimony and <br /> documents were reviewed; and <br /> <br />WHEREAS, the City Council finds that the proposed bridge design is <br /> not appropriately related to, or architecturally <br /> compatible with, the design ofthe existing Bernal Avenue <br /> bridge. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THECITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Upholds the appeal and denies without prejudice the <br /> design for a new, two-lane bridge immediately south of, <br /> and adjacent to, the existing Bernal Avenue bridge, as <br /> required by the conditions of approval of PUD-89-5 and <br /> the Laguna Oaks Specific Plan. <br /> <br /> Section 2: Directs staff to investigate methods to finance a new <br /> steel truss bridge. <br /> <br /> Section 3: Initiates a modification to the conditions of <br /> approval of the PUD to eliminate that portion of the <br /> conditions which require the completion of the Bernal <br /> Avenue bridge prior to occupancy of the final thirty <br /> units. <br /> <br /> Section 4: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
