CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 93-51 <br /> <br /> RESOLUTION DENYING WITHOUT PREJUDICE THE <br /> K~PLIC~TION OF STODD]~x~DDESIGN, INC., AS FILED <br /> UNDER CASE Z-92-174 <br /> <br />WHEREAS, the Design Review Board approved Case Z-92-174, the <br /> application of Nick Stoddard Design, Inc., on behalf of <br /> Mike Ali, for design review approval to construct an <br /> approximately 7,490 square foot, two-storyhome on a 9.55 <br /> acre site located at 20 Twelve Oaks Drive; and <br /> <br />WHEREAS, zoning for the property is PUD-LDR/OS (Planned Unit <br /> Development - Low Density Residential/Open Space) <br /> District; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal <br /> Code, the decision was appealed to the City Council of <br /> Pleasanton; and <br /> <br />WHEREAS, a public hearing was held before the City Council on <br /> May 4, 1993, at which time all pertinent testimony and <br /> documents were reviewed; and <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The Council determines that the proposed home is not <br /> appropriate for the site because of its size in relation <br /> to other existing homes within the Tract; because of the <br /> visual impact the house will have from the valley floor <br /> which impact has not been adequately mitigated; because <br /> the location of the house on the lot will be difficult to <br /> access for public safety vehicles and as such presents a <br /> danger to the public health, safety and welfare. <br /> <br /> Section 2: Upholds Case AP-93-03, and denies, without prejudice, <br /> the application of Nick Stoddard Design, Inc., on behalf <br /> of Mike Ali, for design review approval to construct an <br /> approximately 7,490 square foot, two-story home on a 9.55 <br /> acre site located at 20Twelve Oaks Drive, as filed under <br /> Case Z-92-174. <br /> <br /> Section 3: The City Clerk shall forward a certified copy of this <br /> resolution to the applicant with a notice that the <br /> applicant has ninety (90) days following the date of <br /> adoption of this resolution i which to seek judicial <br /> review of this action of the City Council. <br /> <br /> <br />
