CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 93-49 <br /> <br /> RESOLUTION APPROVING SECOND AMENDMEMT TO <br /> ~GREEMENT WITH STATE OF CALIFORNI~ FOR <br /> IL~CZENDA DRZVE/Z-S80 ZNTERCH]&NGE]&NDAUXZLI]&RY <br /> L]&NES <br /> <br />WHEREAS, at its meeting of May 4, 1993, the City Council reviewed <br />the report of the Director of Public Works and Utilities <br />(SR 93:181) regarding the proposed second amendment to <br />the Cooperative Agreement with the State of California <br />for Hacienda Drive/I-580 Interchange and auxiliary lanes; <br />and <br /> <br />WHEREAS, the amendment eliminates the requirement of an Escrow <br /> Agreement to cover the construction costs of the <br /> auxiliary lanes on 1-580 between Tassajara Creek at <br /> Hopyard Road and will result in a direct payment to BART <br /> for the construction costs of the auxiliary lanes during <br /> its Dublin-Pleasanton Extension Project; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Approves the Second Amendment to the Cooperative <br /> Agreement with the State of California, a copy of which <br /> is attached hereto and incorporated herein by this <br /> reference. <br /> <br />Section 2: Authorizes the City Manager to execute said amendment. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLYADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON MAY 4, 1993 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Dennis, Mohr, Pic0, Scribner, and Mayor <br /> Tarvet <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> Pegg~ ~:~E~idr~, City Clerk <br /> <br />Michael H.
