CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 93-28 <br /> <br /> RESOLUTION ESTABLISHING TIE VOTE PROCEDURE FOR <br /> 3/2/93 SPECIAL ELECTION AND AUTHORIZING CITY <br /> CT~RKTO CONDUCT OFFICIAL CANVASS <br /> <br />WHEREAS, at its meeting of February 16, 1993, the City Council <br /> reviewed the report of the City Clerk (SR 93:67) <br /> regarding Elections Code procedures required to be taken <br /> prior to the Special Election on 3/2/93; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: In the event of a tie vote at the Special Election on <br /> March 2, 1993, a special run-off election shall be held <br /> on a Tuesday, not less than 40 days nor more than 125 <br /> days after the certification of the election which <br /> resulted in the tie vote. <br /> <br />Section 2: If a regular election is to be held throughout the City <br /> during this time period, the special run-off election <br /> shall be consolidated with the regular election. <br /> <br />Section 3: Pursuant to Elections Code, Section 22932.5, the City <br /> Council orders the canvass to be made by the City Clerk <br /> prior to the first Tuesday after the election. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON FEBRUARY 16, 1993 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Pico, Scribner, and Mayor Tarver <br />NOES: None <br />ABSENT: Councilmember Mohr <br />ABSTAIN: None <br /> <br /> Pegg~U. 0E~idr~ City Clerk <br /> <br /> <br />
