CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 93-24 <br /> <br /> RESOLUTION PERMITTING CITY OF PT~ASANTON TO <br /> JOIN IN AMICUS BRIEF <br /> <br />WHEREAS, there is pending in the Court of Appeal, Oden v. Public <br /> Employees' Retirement System, in which important issues <br /> concerning the calculation of retirement benefits will be <br /> decided; and <br /> <br />WHEREAS, an amicus curiae (friend of the court) brief in which <br /> other cities may join at no cost is being prepared; and <br /> <br />WHEREAS, the City Attorney has recommended to the City Council <br /> that the City of Pleasanton be added to the amicus curiae <br /> brief, at no out-of-pocket expense to the City. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Council hereby approves joinder of the City of <br /> Pleasanton in the amicus curiae brief in the case of Oden <br /> v. Public Employees' Retirement System, such <br /> participation to be at no out-of-pocket expense to the <br /> City of Pleasanton. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON FEBRUARY 16, 1993 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Pico, Scribner, and Mayor Tarver <br />NOES: None <br />ABSENT: Councilmember Mohr <br />ABSTAIN: None <br /> <br /> Pegg~/fzidr~, City Clerk <br /> AS · <br /> <br />Michael H.
