CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 93-02 <br /> <br /> RESOLUTION PERMITTING CITY OF PT~ASANTON TO <br /> JOIN IN AMICUS BRIEF <br /> <br />WHEREAS, pending in the California Supreme Court is Roberts v. <br /> City of Palmdale that will determine important issues <br /> concerning attorney-client privilege for public agencies <br /> a well as determining the appropriate remedy for alleged <br /> violations; and <br /> <br />WHEREAS, the amici curiae (friends of the court) brief is being <br /> prepared in which other cities may join at no cost; and <br /> <br />WHEREAS, the City Attorney has recommended to the City Council <br /> that the City of Pleasanton be added to the amici curiae <br /> brief, at no out-of-pocket expense to the local <br /> taxpayers; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Council hereby approves joinder of the City <br /> of Pleasanton in the amici curiae brief in the case of <br /> Roberts v. City of Palmdale, such participation to be at <br /> no out-of-pocket expense to the City of Pleasanton. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON JANUARY 5, 1993 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Mohr, Pico, Scribner, and Mayor Tarvet <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> Pegg~.0~zidro,~ity Clerk <br />APPROVED AS : <br /> <br />Michael H.
