CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 99-029 RESOLUTION OBJECTING TO COUNTY SALE OF TAX DEFAULTED PROPERTY (KOTTINGER DRIVE - APN 094 0032 011 00) AND FINDING THAT THE PROPERTY IS NEEDED FOR PUBLIC USE BY THE CITY OF PLEASANTON WHEREAS, the County Tax Collector has advised the City that a 1.48-acre parcel of property located at Kottinger Drive adjacent to McKinley Park (APN 094-0021-011-00) (the "Property") has become subject to sale for failure to pay taxes in the amount of approximately $89,535.17; and WHEREAS, pursuant to Revenue & Taxation Code §3695.4, the City of Pleasanton objects to the sale of the Property because the entire Property is needed for a public use for park and recreation purposes within the City; and WHEREAS, the City requires a fee interest in the entire 1.48-acre parcel for public park and recreation use. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The City Council objects to the County Tax Collector's sale of a 1.48-acre parcel of property located at Kottinger Drive adjacent to McKinley Park (APN 094-0021-011-00) because the property is needed for public parks and recreation uses by the City of Pleasanton. Section 2: The City Council directs the City Manager to execute all necessary documents and agreements to effectuate the City's acquisition of the Property from the County, including but not limited to the execution of an application to purchase the Property under Chapter 8 of the Revenue & Taxation Code. Section 3: Appropriates the necessary funds from the In-Lieu Park Dedication Fee fund to pay for the acquisition of the Property. Section 4: This resolution shall become effective immediately upon its passage and adoption.
