CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 99-029 <br /> <br /> RESOLUTION OBJECTING TO COUNTY SALE OF TAX <br /> DEFAULTED PROPERTY (KOTTINGER DRIVE - APN <br /> 094 0032 011 00) AND FINDING THAT THE PROPERTY IS <br /> NEEDED FOR PUBLIC USE BY THE CITY OF <br /> PLEASANTON <br /> <br />WHEREAS, the County Tax Collector has advised the City that a 1.48-acre parcel of property <br /> located at Kottinger Drive adjacent to McKinley Park (APN 094-0021-011-00) <br /> (the "Property") has become subject to sale for failure to pay taxes in the amount <br /> of approximately $89,535.17; and <br /> <br />WHEREAS, pursuant to Revenue & Taxation Code §3695.4, the City of Pleasanton objects to <br /> the sale of the Property because the entire Property is needed for a public use for <br /> park and recreation purposes within the City; and <br /> <br />WHEREAS, the City requires a fee interest in the entire 1.48-acre parcel for public park and <br /> recreation use. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Council objects to the County Tax Collector's sale of a 1.48-acre parcel <br /> of property located at Kottinger Drive adjacent to McKinley Park (APN <br /> 094-0021-011-00) because the property is needed for public parks and recreation <br /> uses by the City of Pleasanton. <br /> <br />Section 2: The City Council directs the City Manager to execute all necessary documents and <br /> agreements to effectuate the City's acquisition of the Property from the County, <br /> including but not limited to the execution of an application to purchase the <br /> Property under Chapter 8 of the Revenue & Taxation Code. <br /> <br />Section 3: Appropriates the necessary funds from the In-Lieu Park Dedication Fee fund to <br /> pay for the acquisition of the Property. <br /> <br />Section 4: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> <br />
