EXHIBIT "B" <br /> CITY COUNCIL <br /> CONDITIONS OF APPROVAL <br /> UP-98-19 - GREENBRIAR SYCAMORE VALLEY COMPANY <br /> DETACHED SECOND UNIT APPROVAL <br /> <br />1. Development shall be substantially as shown on the floor plan, site plan, and <br /> elevations, dated "Received April 1, 1998," and the Second Unit Site Exhibit, <br /> dated January 20, 1999, Exhibit "A," on file with the Planning Department, except <br /> as modified by the following conditions. Minor changes to the plans may be <br /> allowed subject to the approval of the Planning Director if found to be in <br /> substantial conformance to the approved exhibits. <br /> <br />2. Only one second unit is allowed on any lot. <br /> <br />3. No detached second units may be constructed on those lots which are adjacent to <br /> the existing lots located to the north (PUD development plan and tentative map <br /> Lots #4-#7, #11-#13, and #19-#28). <br /> <br />4. The rear yard setback for detached second units in the PUD-LDR lots shall be ten <br /> (10) feet and the side yard setback shall be five (5) feet. The rear and side yard <br /> setbacks for the PUD-A lots shall be twenty (20) feet. The maximum height shall <br /> be firmen feet. <br /> <br />5. No more than twenty (20) detached second units shall be constructed on the 33 <br /> PUD-LDR lots designated on the Second Unit Site Exhibit under this master <br /> conditional use permit. The nine PUD-A lots along Sycamore Road shall be <br /> excluded from this use permit. <br /> <br />6. Only one residential unit on any property with a primary and secondary residence <br /> may be rented. The other unit shall be owner-occupied. A second unit shall be <br /> occupied by no more than two adults, although there shall be no limit on the <br /> number of children. The developer shall indicate this condition in written form on <br /> a deed restriction to any buyer who has selected a second-unit option, and the <br /> language of this deed restriction shall be submitted to the City Attomey for review <br /> and approval prior to the issuance of building permits for any residence. <br /> <br />UP-98-019 City Council Conditions of Approval Page 1 of 3 <br /> <br /> <br />
