EXHIBIT "B" <br />Conditions of Approval <br />Case Z-98-296 <br /> Red Bear Inc. <br /> <br />PLANNING <br /> <br />o <br /> <br />o <br /> <br />Development shall be substantially as shown on the development plans and <br />colorboard, Exhibit "A", dated "Received December 18, 1998" on file with the <br />Planning Department, except as modified by the following conditions. Minor <br />changes to the plans may be allowed subject to the approval of the Planning <br />Director if found to be in substantial conformance to the approved exhibits. <br /> <br />The applicants shall obtain all building and other applicable City permits for the <br />project prior to the commencement of construction. <br /> <br />The developer shall pay any and all fees to which the property may be subject <br />prior to issuance of building permits. The type and amount of the fees shall be <br />those in effect at the time the building permit is issued. <br /> <br />This design review approval shall lapse and shall become void one year from the <br />date of approval unless a building permit is issued and construction has <br />commenced and is diligently pursued toward completion or an extension has been <br />approved by the City. <br /> <br />Approval of this design review application shall be contingent upon approval of <br />the Downtown Specific Plan amendment to allow three-story buildings in the <br />Downtown Specific Plan Area (Case SPA-98-03). <br /> <br />The applicants shall apply for and be granted a conditional use permit by the <br />Planning Commission prior to serving alcohol from the bar. <br /> <br />No building permits may be issued until a Lot Line Adjustment is recorded which <br />merges the adjacent 1,500 sq. ti. portion of the Pleasanton Hotel property (855 <br />Main Street) as shown on the approved site plan and the applicants' property (807 <br />Main Street) into one parcel. <br /> <br />The applicants shall record a 5 Ii. wide, non-buildable easement over the <br />Pleasanton Hotel lot (855 Main Street) as shown on the site plan.
