CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 99-018 <br /> <br />RESOLUTION <br />DOWNTOWN <br />SPA-98-03 <br /> <br />ADOPTING A AMENDMENT TO THE <br />SPECIFIC PLAN, AS FILED UNDER CASE <br /> <br />WHEREAS, Red Bear, Inc. has applied to amend the adopted Downtown Specific Plan to <br /> permit new or remodeled three-story buildings on a case-by-case basis; and <br /> <br />WHEREAS, <br /> <br />the Planning Commission conducted a public hearing on the application and <br />recommended on January 27, 1999 that the City Council approve the amendment <br />to the Specific Plan and adopt a negative declaration of environmental impact; and <br /> <br />a public hearing was called and duly noticed for March 2, 1999, at which time the <br />City Council reviewed the proposed amendment to the Downtown Specific Plan <br />and considered all related reports, documents, testimony, and recommendations; <br />and <br /> <br />WHEREAS, <br /> <br />the City Council finds that no potentially significant environmental effects have <br />been identified by the Initial Study of Environmental Impacts or that any impacts <br />either have been mitigated by project conditions of approval or modifications <br />made to the project during the review process; and <br /> <br />WHEREAS, the City Council finds, that the adoption of the amendment to the Downtown <br /> Specific Plan is consistent with the General Plan. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />Approves the application of Red Bear, Inc. to amend the Downtown Specific Plan <br />to permit new or remodeled three-story buildings on a case-by-case basis, as <br />shown on "Exhibit C," attached hereto and made a part of this case by reference. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> <br />
