~,~$~.,,x.] CITY COUNCIL OF THE CITY OF PLEASANTON <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 99-001 <br /> <br /> RESOLUTION QUITCLAIMING THE CITY'S INTEREST IN <br /> AN EXISTING EASEMENT AND ACCEPTING A REVISED <br /> EASEMENT FOR OWENS PLAZA PARK <br /> <br />WHEREAS, Security Capital Pacific Trust received approval for a 540 unit apartment complex <br /> and recorded Parcel Map 7202; and <br /> <br />WHEREAS, Parcel Map 7202 included a three acre park dedicated to the City for public use <br /> (Owens Plaza Park); and <br /> <br />WHEREAS, the recorded map created an easement in favor of the City for ingress, egress, <br /> parking and public service purposes; and <br /> <br />WHEREAS, due to modification of the traffic signal at Owens and Rosewood Drives, the <br /> easement needs to be shiaed slightly to the east in order to contbrm to the traffic <br /> lanes; and <br /> <br />WHEREAS, the City Council has reviewed the location of the proposed new easement, finds it <br /> confi3rms to the correct alignment of the traffic lanes, finds there is no difference <br /> in the area to be encumbered by the easement, thereby insuring the City will <br /> continue to have an easement for ingress, egress, parking and public service <br /> purposes for the benefit of the park site, and finds that the City has no interest or <br /> need for the existing easement except to the extent there is overlap with the <br /> proposed new easement; <br /> <br />NOW, THEEFOE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Accepts from Archstone Community Trust (formerly Security Capital Pacific <br /> Trust) the Grant of Easement, more particularly described in the attached Exhibit <br /> A. <br /> <br />Section 2: Authorizes the City Manager to sign a deed quitclaiming to Archstone Community <br /> Trust the City's interest in the existing easement for ingress, egress, parking and <br /> public service purposes. <br /> <br /> <br />
