ATTACHMENT 1 <br /> <br /> City of Heasanton <br /> Department of Parks & Community Services <br /> <br /> CONTRACT FOR INSTRUCTIONAL SERVICES <br /> <br /> THIS AGREEMENT is made and entered into this __ day of , <br />1993, by and between the CITY OF PLEASANTON, a municipal corporation (hereinafter <br /> <br />referred to as the "City"), and , whose <br />address is , and telephone number is <br /> , (hereinafter referred to as the "Contractor"). <br /> <br /> WITNESSETH: <br /> <br /> A. Contractor is qualified to provide, and experienced in providing, instruction <br />services in the area(s) of: <br /> <br />and has offered its services for the purposes specified in this Agreement. <br /> B. In the judgment of the City, it is necessary and advisable to employ the services <br />of Contractor for the purposes provided herein. <br /> <br /> NOW, THEREFORE, in consideration of the mutual covenants, agreements and <br /> conditions contained herein, City and Contractor agree as follows: <br /> <br /> 1. Contractor's Services. Contractor shall diligently perform the services and <br /> furnish the supplies and related materials as hereinafter set forth: <br /> a. Contractor shall perform all work described in Exhibit "A" , Scope of <br /> Work; Exhibit "B", Class Fact Sheet(s); and Exhibit "C", Class Syllabi, attached <br /> hereto and incorporated herein by this reference. <br /> <br /> 2. Staff. The on-site instructor(s) for the Contractor shall be clearly indicated on <br /> Exhibit B, Class Fact Sheet(s). <br /> <br /> a. Contractor shall not replace named on-site instructor(s) without prior <br /> approval of the City. The Contractor shall provide to the City a completed <br /> Employee Information Form for each employee. <br /> <br /> 3. Ownership of Work. When applicable, all reports and other documents <br /> completed or partially completed by Contractor in the performance of this Agreement shall <br /> become the property of City. <br /> <br /> <br />
