CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> RESOLUTION NO. 94-37 <br /> <br /> RESOLUTION ADDING AGENDA ITEM REGARDING <br /> ASSEMBLY CONSTITUTIONAL AMENDMENT NO. 1 <br /> <br />WHEREAS, it is staffs understanding that the Congestion Management Agency (CMA) is <br /> planning on discussing at its April 22, 1994 meeting Assembly Constitutional <br /> Amendment No. 1, regarding general obligation bonds approved by a majority <br /> vote; and <br /> <br />WHEREAS, the CMA has requested that its member agencies take a position on this <br /> Constitutional amendment; and <br /> <br />WHEREAS, this item was not set forth on the City Council agenda for April 19, 1994 because <br /> the CMA agenda was not known until after the April 19, 1994 City Council <br /> agenda had been posted; and <br /> <br />WHEREAS, the Brown Act permits the Council to add an item to the agenda upon a two-thirds <br /> vote of the Council on a finding that the need for action on the item arose after <br /> the time the agenda was posted; and <br /> <br />WHEREAS, the City Council finds that the need for action on the item arose after the agenda <br /> had been posted and the Council needs to discuss this proposal and make its <br /> position known to the Congestion Management Agency at its April 22nd meeting, <br /> which will occur before the City Council meets again. <br /> <br />NOW, TI-IEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Discussion of ACA No. 1 is hereb~ added to the April 19, 1994 agenda for <br /> Council consideration and action, if necessary. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON APRIL 19, 1994 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Dennis, Mohr, Pico, Scribner, and Mayor Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> ATTEST: <br /> <br /> PeggyCL~E~d~6, CitSFClerk <br /> <br />Michael H.
