9 07615 <br /> <br />Resolution No. 94-15 <br />Page 3 <br /> <br />WHEREAS, the Government Cede permits such refunds to be made; and <br /> <br />WHEREAS, A-M Homes has various agreements with the City, including the aforementioned <br /> Subdivision Improvement Agreement and the bonds to secure performance, <br /> Growth Management Agreement, and Indemnity Agreement; if the project is not <br /> built, then there is no neext for these Agreements to continue in full force and <br /> effect; and <br /> <br />WHEREAS, Tract 6362 surrounds property owned by Lynn Anne Sorenson ("the Sorenson <br /> property"); and <br /> <br />WHEREAS, Ms. Sorenson has raised issues concerning A-M Homes' providing City water <br /> service to the Sorenson property; and <br /> <br />WHEREAS, although A-M Homes denies any legal responsibility to provide City water service <br /> to the Sorenson property, it has agreed to the following: A-M Homes will <br /> (a) provide a one inch water service from Foothill Road near the northern <br /> boundary of Parcel Map 6697; (b) pay appropriate water connection fees in order <br /> to set a 3/4" water meter at the 1" water service; (e) provide a 2" water line to <br /> approximately elevation 450'; (d) provide a water holding tank and water pump <br /> with electrical connection; (e) provide a 1" water line from the water pump to <br /> within ten feet of the place where the existing water line from the spring pump <br /> crosses the Sorenson northwesterly property line; (f) design and construct all the <br /> work described above by March 1, 1994 and to the ntis/action of the City <br /> Engineer; and (g) grant an irrevocable easement to Ms. Sorenson for the two inch <br /> water line; and <br /> <br /> WHEREAS, the CEQA Guidelines provide that reversions to acreage in accordance with the <br /> Subdivision Map Act are categorically exempt from CEQA provisions; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br /> AS FOLLOWS: <br /> <br />Section 1: The City allandons the City's interest in Parcels A and H, Tract 6362, filed <br /> January 20, 1993, in Map Book 206, Page 62, Alameda County Records. <br /> <br /> Section 2: The City accepts in fee title that portion of Foothill Road as described in Exhibit <br /> "A* , attached hereto and incorporated herein by this reference. <br /> <br /> Section 3: The City finds that except as provided in Section 2 above, all other dedications <br /> or offers of dedication as shown on Tract Map 6362 are vacated or abandoned <br /> because they are unnecessary for prospective public purposes and that all owners <br /> have consented to the reversion of Tract 6362 to acreage. <br /> <br /> <br />
