CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 94-06 <br /> <br /> RESOLUTION PERMITtING CITY OF PLEASANTON TO <br /> JOIN IN AMICUS BRIEF <br /> <br />WHEREAS, them is pending in the Court of Appeal, No More Garbage in Pittsburg <br /> Committee v. Pride. et al., in which important issues concerning referendum <br /> petitions will be decided; and <br /> <br />WHEREAS, an amicus curiae (friend of the court) brief in which other cities may join at no <br /> cost is being prepared; and <br /> <br />WHEREAS, the City Attorney and the City Clerk have recommended to the City Council that <br /> the City of Pleasanton be added to the amicus curiae brief, at no out-of-pocket <br /> expense to the City. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON P,F~OLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Council hereby approves joinder of the City of Pleasanton in the amicus <br /> curiae brief in the case of No More Garbage in Pittsburg Committee v, Pride. et <br /> al., such participation to be at no out-of-pocket expense to the City of Pleasanton. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT 14I-IE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON JANUARY 18, 1994 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Dennis, Mohr, Pico, Scribner, and Mayor Tarvet <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> ATTEST: <br /> <br /> Peggy ~:.QE~dYo, Cit~Clerk <br /> <br />Michael H.
