· ' : CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 95-129 <br /> <br /> RESOLUTION REGARDING ~ WIDENING OF <br /> RAY STREET AT MAIN STREET AND MODIFYING <br /> CERTAIN CONDITIONS OF APPROVAL FOR THE <br /> PROJECT AT 780 MAIN STREET <br /> <br /> WHEREAS, on July 18, 1995, the City Council conditionally approved a design for a <br /> building to be constructed at 780 Main Street; and <br /> <br /> WHEREAS, those conditions included the property owner to dedicate two feet of <br /> property fronting Ray Street for right of way purposes and the property <br /> owner to pay the City $25,000 for street improvements along Ray Street; <br /> and <br /> <br /> WHEREAS, the City Council directed staff t.o prepare a report concerning the need in <br /> the near term to widen Ray Street near its intersection with Main Street; and <br /> <br /> WHEREAS, the property owner (Ed Churka) has requested to be relieved not only of the <br /> condition to dedicate the two feet of property along Ray Street for <br /> right-of-way purposes, but also of the condition to pay the $25,000 fee for <br /> street improvements; and <br /> <br /> WHEREAS, at its meeting of November 7, 1995, the City Council reviewed the staff <br /> report of the Director of Public Works (SR 95:367) regarding whether Ray <br /> Street at Main Street should be widened in the short term and whether the <br /> conditions of approval mentioned above should be modified; and <br /> <br /> WHEREAS, Council received testimony regarding the subject; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> <br /> Section 1: Ray Street at its intersection with Main Street is not to be widened at this <br /> time. <br /> <br /> Section 2: The two conditions of approval described above are modified as follows: <br /> <br /> a. The property owner shall grant the City an open offer of dedication <br /> for right-of-way purposes as to the two feet of property fronting Ray <br /> Street. <br /> <br /> b. The property owner is not obligated to pay the City $25,000 for <br /> street improvements along Ray Street. <br /> <br /> <br />
