CITY COUNCIL OF THE CITY OF PLEASA/~ON <br /> <br /> ALAIVIEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 95-139 <br /> <br /> RESOLUTION APPROVING A LOAN TO ROD'S <br /> mCKORY PIT RESTAURANT FOR SEWER <br /> CONNECTION FEES <br /> <br />WHEREAS, on February 21, 1989, the City Council adopted Resolution No. 89-94, <br /> establishing a loan program to encourage restaurants to locate in the <br /> downtown area; and <br /> <br />WHEREAS, due to circumstances beyond its control, Rod's Hickory Pit is relocating its <br /> business and has chosen a site in the Oak Hills Shopping Center, which is <br /> outside the "downtown" area as defined in the above resolution; and <br /> <br />WHEREAS, at its meeting of November 28, 1995, the City Counc~ reviewed the staff <br /> report (SR 95:383) from the City Manager requesting an exception to the <br /> policy to allow a loan for sewer connection fees outside the downtown area; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Authorizes approval of a loan for sewer connection fees to Rod's Hickory <br /> Pit Restaurant, pursuant to the terms and conditions set forth in the staff <br /> report, and further provided that in the event of a default on the loan, all <br /> sewer capacity which has been purchased shall revert to the City of <br /> Pleasanton. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> <br /> <br />
