CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 95-135 <br /> <br /> RESOLUTION DECLARING A SURPLUS IN <br /> IMPROVEMENT FUND, NORTH PLEASANTON <br /> IMPROVEMENT DISTRICT NO. 1, ASSESSMENT <br /> DISTRICT NO. 1982-4 <br /> <br /> WHEREAS, the City Council adopted various Resolutions of Intention for roadway <br /> improvements in the North Pleasanton Improvement District (NPID) No. 1, <br /> Assessment District No. 1982-4, City of Pleasanton, Alameda County, <br /> California; and <br /> <br /> WHEREAS, said Resolutions of Intention proVided that any surplus in the improvement <br /> fund for said assessment would be applied in accordance with Section <br /> 10427.1 of the Streets and Highways Code of the State of California; and <br /> <br /> WHEREAS, most improvements have been completed and as to the improvements which <br /> have not been completed, adequate funds have been set aside to complete <br /> this work; and <br /> <br /> WHEREAS, on November 21, 1995, the City Council reviewed the report of the Public <br /> Works Director (SR 95:391) concerning the partial disWibution of surplus in <br /> this District; and <br /> <br /> WHEREAS, as to those properties owned by the Prudential Insurance Company, <br /> Prudential has agreed that its share of the surplus not be returned/refunded <br /> to it but instead that its share be retained by the City to use for future traffic <br />_ improvements or for other capital projects including park facilities. <br /> <br /> NOW, THEREFORE, TIlE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> <br /> Section 1: A balance of $3,217,000+ remains in the improvement fund for NPID No. <br /> 1, Assessment DisWict No. 1982-4, of which $1,726,911 is surplus. <br /> <br /> <br />
