CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 95-126 <br /> <br /> RESOLUTION DENYING THE APPLICATION OF <br /> LYNDEN HOMES FOR REZONING AND <br /> DEVELOPMENT PLAN APPROVAL FOR THIRTEEN <br /> SINGLE-FAMILY UNITS, AS FILED UNDER CASE <br /> PUD-95-03 <br /> <br />WHEREAS, Lynden Homes applied to rezone a 1.01 acre parcel from the Agricultural <br /> zoning district to the PUD - MDR (Medium Density Residential) District <br /> and for a Planned Unit Development approval (over 4.30+ acres) for a <br /> 13-unit single-family residential development located at 1777 and 1635 <br /> Rose Avenue; and <br /> <br />WHEREAS, zoning for the property is PUD-MDR (Planned Unit Development - <br /> Medium Density Residential) and A (Agricultural) Districts; and <br /> <br />WHEREAS, Council received the Planning Commission's recommendations for <br /> approval of the development plan; and <br /> <br /> WHEREAS, a duly noticed public heating was held on October 17, 1995; and <br /> WHEREAS, the matter was continued to October 24, 1995 for decision; and <br /> WHEREAS, the City Council finds that the proposed rezoning and proposed <br /> development plan is not consistent with the General Plan because the <br /> 10,000 sq. ft. minimum lot size has not been met for all thirteen lots; and <br /> <br /> WHEREAS, the City Council fmds that the flag lots are not an acceptable lotting pattern <br /> and there is no direct access to the arroyo. <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> <br /> Section 1: Denies the application of Lynden Homes, as filed under Case PUD-95-03, <br /> for a rezoning and a PUD plan. <br /> <br /> <br />
