CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 95-125 <br /> <br /> RESOLUTION FINDING THAT LOWER-INCOME <br /> HOUSING FUNDS ARE COMMITTED TO A <br /> PARTICULAR PROJECT <br /> <br />WHEREAS, Government Code §66001(d), effective January 1, 1989, requires the City <br /> to make findings once each fiscal year with respect to any portion of a fee <br /> remaining unexpended or uncommitted in its account five or more years <br /> after deposit of the fee, and to identify the purpose to which the fee is to be <br /> put and to demonstrate a reasonable relationship between the fee and the <br /> purpose for which it was charged; and <br /> <br />WHEREAS, staff has reviewed the development fees collected between July 1, 1989 and <br /> June 30, 1990 to determine if any such development fees remain <br /> unexpended or uncommitted; and <br /> <br />WHEREAS, staff has found that no development impact fees for this period remain <br /> unexpended or uncommitted; and <br /> <br />WHEREAS, other revenues, however, were received or generated by the City's <br /> Lower-Income Housing Fund during this period; and <br /> <br /> WHEREAS, previously the City Council has made a commitment of $4.4 million to <br /> assist in the construction of the Case Avenue Project, a lower income <br /> housing project scheduled to begin construction in late 1995; and <br /> <br /> WHEREAS, the $4.4 million commitment, less the $2.2 million already expended, <br /> exceeds the revenues remaining in the Lower-Income Housing Fund <br /> collected between July 1, 1989 and June 30, 1990. <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> <br /> <br />
