EXHIBIT 1 <br /> <br /> CONDITIONS OF APPROVAL <br /> <br /> CITY COUNCIL <br /> <br /> Ken Sewell, AP-95-6, V-95-10 <br /> <br /> October 17, 1995 <br /> <br />1. The location and design of the carport shall substantially conform to the site plan and <br /> building elevations, Exhibit "A", dated "Received May 25, 1995 on file with the Planning <br /> Department, except as modified by these conditions. <br /> <br />2. The applicant shall receive all applicable permits for the carport within 30 days of approval <br /> of the variance. <br /> <br />3. The applicant shall relocate the carport such that the centerlines of the carport posts are <br /> 16 inches from the side yard fence; the roof, fascia board, and roof gutter may extend, <br /> with minimal overhang, into the 16 inch setback in a manner satisfactory to the Planning <br /> Director. <br /> <br />4. The applicant shall use fire resistive materials on the carport posts and portions of the roof <br /> as directed by and subject to the approval of the Director of Building Inspection. <br /> <br />5. The applicant shall ensure that all stormwater runofffrom the carport is contained on his <br /> own property. <br /> <br />6. The variance approval shall expire upon sale of the property, and the carport shall either <br /> be removed or modified so as to conform to the Code requirements in effect at that time, <br /> except, however, that the carport may be allowed to remain if the new property owners <br /> receive approval of a new variance. This requirement shall be set forth in a document, <br /> approved as to form by the City Attorney, and recorded in Alameda County. <br /> <br />7. The applicant shall repair and maintain that portion of the common property line fence <br /> which is adjacent to the carport. <br /> <br /> {end} <br /> <br /> <br />
