CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 95-120 <br /> <br /> RESOLUTION UPHOLDING THE APPEAL OF A <br /> DECISION OF THE PLANNING COMMISSION AND <br /> GRANTING A VARIANCE FROM THE MUNICIPAL <br /> CODE TO ALLOW A CARPORT WHICH <br /> ENCROACHES WITHIN THE REQUIRED SIDE YARD <br /> SETBACK AT 7254 SOUTH VALLEY TRAILS DRIVE <br /> <br />WHEREAS, Kenneth Sewell, the owner of property at 7254 South Valley Trails Drive, <br /> applied to the City for a variance to allow a carport which encroaches <br /> within the required side yard setback at the property; and <br /> <br />WHEREAS, zoning for the property is R-1-6,500 (Single-family Residential) District; <br /> and <br /> <br />WHEREAS, at its meeting of July 26, 1995, the Planning Commission denied the <br /> application of Kenneth Sewell for the variance; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, Kenneth <br /> Sewell submitted an appeal to the City Clerk of the City of Pleasanton; and <br /> <br /> WHEREAS, a public heating was held before the City Council on October 3, 1995, at <br /> which time all pertinent testimony and documents were reviewed; and <br /> <br /> WHEREAS, the matter was continued to October 17, 1995 for a decision; and <br /> <br /> WHEREAS, after a review of the material presented, the City Council makes the <br /> following finding: <br /> <br /> a. That because there are special circumstances having to do with the <br /> efficient utilization of the subject property, the strict application of <br /> the provisions of the Code would deprive the property owner of <br /> privileges enjoyed by other properties in the vicinity and under the <br /> identical zoning classification. <br /> <br /> <br />
