Resolution No. 95-101 <br />Page Two <br /> <br />Section 3: Certifies that the City shall perform all acts and obligations of the City <br /> under the application and the instruments and documents delivered pursuant <br /> thereto. <br /> <br />Section 4: Certifies that the City has or will have sufficient funds to operate and <br /> maintain the project. <br /> <br />Section 5: Certifies that the City shall use the funds from the Local Grant Program to <br /> develop the project in accordance with the application. <br /> <br />Section 6: Certifies that the City reasonably expects to complete the project within <br /> three years from the agreement date. <br /> <br />Section 7: Appoints the Director of Parks and Community Services as agent of the <br /> City of Pleasanton to conduct all negotiations, execute and submit all <br /> documents including, but not limited to, applications, agreements, <br /> amendments, payment requests and so on which may be necessary to the <br /> completion of the aforementioned project in such form and pursuant to such <br /> provisions as EBRPD and the City shall agree. <br /> <br />Section 8: This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON, AT A MEETING HELD ON SEPTEMBER 5, 1995 BY THE <br />FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Dennis, Michelotti, Mohr, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> ATFEST: <br /> <br /> Peggyc~L~.L~i~ro, ~ty Clerl~ <br />APPROVED AS TO ~ <br /> <br />Michael H.
