CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 95-92 <br /> <br /> RESOLUTION ORDERING TIlE FORMATION OF TIlE <br /> MOLLER RANCH GEOLOGIC HAZARD ABATEMENT <br /> DISTRICT <br /> <br />WHEREAS, on October 18, 1994, pursuant to Secfio_n 26550 of the Public Resources <br /> Code, this Council adopted Resolution No. 94-118A, declaring the Council <br /> subject to the provisions of Division 17 (Section 26500 et sea_.) of said <br /> Code, and forwarded a copy of said Resolution to the State Controller; and <br /> <br />WHEREAS, on July 18, 1995, this Council adopted Resolution No. 95-77, initiating <br /> proceedings for the formation of a geologic hazard abatement district <br /> ("CHAD") for the Moller Ranch project area, setting a public hearing on <br /> the filed petition for August 15, 1995, and directing that notice of the <br /> hearing be mailed in accordance with the requirements of Public Resources <br /> Code Section 26561 to all the owners of all the real property within the <br /> boundaries of the territory to be included within the proposed CHAD; and <br /> <br />WHEREAS, said notice of hearing was mailed to all said owners of real property in <br /> accordance with Public Resources Code Section 26561, or, in lieu thereof, <br /> all said owners of real property submitted to the City Clerk written waivers <br /> of said notice of heating; and <br /> <br />WHEREAS, at the time set for heating, no owner of real property within the boundaries <br /> of the proposed GHAD had made a written objection to its formation; and <br /> <br />WHEREAS, it appeared at the hearing that the owners of more than 50 percent of the <br /> assessed valuation of the proposed GHAD did not object to the formation <br /> thereof, and the Council thereupon closed the heating; and <br /> <br />WHEREAS, the formation of the proposed GHAD is not subject to the California <br /> Environmental Quality Act or the Cortese-Knox Local Government <br /> Reorganization Act of 1985, in accordance with Public Resources Code <br /> Section 26559 and Section 26560; and <br /> <br />WHEREAS, the Council finds that the formation of the GHAD is in the interest of the <br /> public health, safety and welfare; <br /> <br /> <br />
