CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 95-91 <br /> <br /> RESOLUTION DENYING CASE AP-95-08, THEREBY <br /> UPHOLDING APPROVAL OF THE APPLICATION OF <br /> NEW CITIES DEVELOPMENT AS FILED UNDER <br /> CASE UP-95-22 <br /> <br />WHEREAS, the Planning Commission approved Case UP-95-22, the application of New <br /> Cities Development for a master conditional use permit to allow a <br /> secondary dwelling unit option in conjunction with 36 single-family <br /> detached homes on a previously approved subdivision (Walnut Glen Estates, <br /> Tract 6596) located on the northerly side of Trenery Drive, 400 feet <br /> westerly of Martin Avenue; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - LDR (Low <br /> Density Residential) District; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, an appeal was <br /> filed with the City Clerk; and <br /> <br />WHEREAS, a public hearing was held before the City Council on August 15, 1995, at <br /> which time all pertinent testimony and documents were reviewed; and <br /> <br />WHEREAS, the City Council determined that the master conditional use permit is <br /> appropriate for this subdivision. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Denies Case AP-95-08, thereby upholding the decision of the Planning <br /> Commission approving Case UP-95-22, the application of New Cities <br /> Development for a master conditional use permit to allow a secondary <br /> dwelling unit option in conjunction with 36 single-family detached homes <br /> on a previously approved subdivision (Walnut Glen Estates Tract 6596) <br /> located on the northerly side of Trenery Drive, 400 feet weste~y of Martin <br /> Avenue. <br /> <br /> <br />
