City Pleasanton STA REPORT June 20, 1995 Public Works Department SUBJECT: 1995-96 Annual Assessments for Lighting and Landscape District 1993-1, Windsor STAFF RECOMMENDATION: Staff recommends the City Council adopt a resolution confirming the Engineer's Report and levying the annual assessment. SUMMARY: Common area landscaping in the Windsor subdivision is maintained through an assessment district. This maintenance is for the masonry walls, street lighting, trees, shrubbery, groundcover, and irrigation systems situated on the northeast side of Tapestry Way and Minton Court, Lot A in the northwest corner of the subdivision and also Lot C in the southwest corner of the subdivision. A public hearing must be held annually to establish the assessment for the maintenance costs. Honorable Mayor and Members of the Council: BACKGROUND On December 14, 1993, the City Council adopted an ordinance requiring the landscaping of narrow, common strips of land which surround the Laguna Oaks-Windsor subdivision. A further condition of this ordinance required that Laguna Oaks-Windsor Homes enter into an agreement with the City establishing how the landscaping in these areas would be maintained. To accomplish this, Laguna Oaks- Windsor Homes suggested the formation of an "Assessment District," under the conditions of the 1972 "Landscape and Lighting Act." Soon after, the formation of Landscaping and Lighting Assessment District 1993-1 was approved by the City. As required by the Landscaping and Lighting Act of 1972, the City must levy an annual assessment to all parcels benefitted by the Landscape District 1993-1 (see attached diagram). This will be the first year for these assessments. SR:95:195
