· Require the GAP Consultant to prepare an annual report, indicating the <br /> extent of maintenance, repair and replacement and the estimated cost <br /> therefor, a copy of which is to be forwarded to the City; <br /> <br /> · Provide the City with the right, but not obligation, to enforce the GAP if <br /> the Association fails to do so; <br /> <br /> · Identify the 21 lots on or near Lupine Court which will require a stability <br /> analysis where slopes are cut steeper than 3 to 1; and <br /> <br /> · Require lot owners to retain a geotechnical engineer to review, analyze <br /> and prepare a written report concerning proposed alterations and <br /> improvements to the lot prior to work being done; and to require the <br /> GAP's consulting professional(s) to review the analysis. <br /> <br />WHEREAS, the City Council subcommittee which has been working with the Association and <br /> staff recommends that the GAP, along with the amendments to the CC&R' s, be <br /> approved. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Approves the proposed Geologic Abatement Program in substantially the form as <br /> attached to Staff Report 95:187 and the final form of which shall be approved by <br /> the City AUorney and shall include provisions that the geotechnical engineer <br /> retained by the GAP be licensed by the State of California; that the geotechnical <br /> engineer is to observe excavation and provide an "as built" report of the <br /> conditions encountered and the mitigation measures taken; and that the inspection <br /> schedule provide for additional inspections depending on the intensity and <br /> duration of storms and rainfall. <br /> <br />Section 2: Approves the proposed amendments to the CC&R's in substantially the form as <br /> attached to Staff Report 95: 187 and the final form of which shall be approved by <br /> the City Attomey. <br /> <br />Section 3: If the GAP is adopted and maintained, and if the amendments to the CC&R's are <br /> adopted and adhered to,then in the absence of evidence which develops on the site <br /> which warrants a contrary action, the City will undertake no further geological <br /> studies, other than those required by the GAP, or as required to be prepared by <br /> individual homeowners as they develop lots within the subdivision. <br /> <br />Section 4: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> <br />
