CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 95-33 <br /> <br /> RESOLUTION DENYING APPEAL (AP-95-01) <br /> THEREBY UPHOLDING APPROVAL OF TIlE <br /> APPLICATION OF CANDY AND JEFFREY PHILLIPS <br /> AS FILED UNDER CASE UP-94-77 <br /> <br />WHEREAS, the Planning Commission approved Case UP-94-77, the application of <br /> Candy and Jeffrey Phillips for a conditional use permit to establish a large <br /> family day care home (7-12 children) at the existing single-family dwelling <br /> located at 3444 Windsor Court; and <br /> <br />WHEREAS, zoning for the property is R-1-6,500 (Single-Family Residential) District; <br /> and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, Marvyn J. <br /> Siders appealed the decision; and <br /> <br />WHEREAS, a public heating was held before the City council on March 21, 1995, at <br /> which time all pertinent testimony and documents were reviewed; and <br /> <br />WHEREAS, the City Council determined that the proposed use, as conditioned, is <br /> appropriate for the site. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Denies Case AP-95-01, thereby upholding the decision of the Planning <br /> Commission approving Case UP-94-77, the application of Candy and <br /> Jeffrey Phillips for a conditional use permit to establish a large family day <br /> care home (7-12 children) at the existing single-family dwelling located at <br /> 3444 Windsor Court. <br /> <br />Section 2: The City Clerk shall forward a certified copy of this resolution to the <br /> appellant with a notice that the appellant has ninety (90) days following the <br /> date of adoption of this resolution in which to seek judicial review of this <br /> action of the City Council. <br /> <br /> <br />
