CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 95-23 RESOLUTION APPROVING THE REQUEST OF SIGNATURE PROPERTIES FOR PARK DEDICATION FEE CREDIT FOR PROVIDING RUBY HILL PARK WHEREAS, Section 19.44.090 of the Pleasanton Municipal Code provides that in lieu of providing public recreational facilities, a developer may provide private, active recreational facilities and, under certain circumstances, may receive a partial credit for those facilities towards the developer's obligation to provide park and recreation facilities for the community; and WHEREAS, at its meeting of February 21, 1995, the City Council reviewed the report of the Director of Parks and Community Services (SR 95:64) regarding the request of Signature Properties for a 50% credit for providing a private 12.5 acre, fully developed, active neighborhood park for the Ruby Hill property; and WHEREAS, the City Council finds that it is in the public interest to provide the credit because the City (1) will not have to use public funds to purchase park land, (2) will not have to spend public funds to develop the park, (3) will not have to maintain the facilities once constructed, and because the neighborhood park needs of the Ruby Hill residents benefitted by the private facilities will be met; and WHEREAS, the City Council further finds that the proposed private park exceeds all the applicable standards set forth in Section 19.44.090. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Approveg the request of Signature Properties and gives a 50% credit to Signature Properties against its requirement to dedicate land, or pay fees in lieu thereof, for Signature's providing a private 12.5 acre, fully developed neighborhood park within the Ruby Hill development. Section 2: This resolution shall become effective immediately upon its passage and adoption.
