CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 96-147 <br /> <br /> RESOLUTION ADDING AGENDA ITEM REGARDING <br /> THE ALTAMONT LANDFILL <br /> <br />WHEREAS, on December 6, 1996, the Alameda County Board of Supervisors certified <br /> an E1R and approved a conditional use permit for the expansion of the <br /> Altamont Landfill; and <br /> <br />WHEREAS, because of the applicable statute of limitations to challenge the EIR, if the <br /> City Council of Pleasanton chooses to pursue legal action it must do so <br /> before its next regularly scheduled Council meeting date; and <br /> <br />WHEREAS, consideration of such issue was not set forth on the City Council agenda for <br /> December 19, 1996, because action had not been taken by Alameda County <br /> until after the agenda was posted; and <br /> <br />WHEREAS, the Brown Act permits the Council to add an item to the agenda upon a <br /> two-thirds vote of the Council that the item arose after the time the agenda <br /> was posted; and <br /> <br />WHEREAS, a closed session is necessary to discuss potential litigation against Alameda <br /> County because legal action, if it were to be pursued, is necessary before <br /> the next regular session of the City Council. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br /> Section 1: Based on the findings set forth above, a closed session to confer with legal <br /> counsel regarding potential litigation against Alameda County regarding its <br /> certification of an EIR and approval of a conditional use permit to expand <br /> the Altamont Landfill is hereby added to the December 19, 1996 agenda for <br /> Council consideration and action, if necessary. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> <br /> <br />
