CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 96-143 <br /> <br /> RESOLUTION DENYING THE REQUEST TO <br /> EXTEND GROWTH MANAGEMENT APPROVAL <br /> FOR OAK TREE FARM, PHASE III <br /> <br />WHEREAS, in 1992, City Council granted growth management approval to the Oak <br /> Tree Farm project as follows: 20 units in 1993, 20 in 1994 and 14 in 1995; <br /> and <br /> <br />WHEREAS, under the growth management program then in existence, the developer was <br /> obligated to obtain a final map by December 31, 1996 for the 14 lots in the <br /> 1995 growth management approval (Phase III, Oak Tree Farm); and <br /> <br />WHEREAS, the developer does not yet have tentative map approval for those 14 lots and <br /> will not have final map approval for those 14 lots by December 31, 1996; <br /> and <br /> <br />WHEREAS, the developer has requested that its growth management approval for those <br /> 14 lots be extended to June 30, 1997; and <br /> <br />WHEREAS, at its meeting of December 3, 1996, the City Council reviewed the report of <br /> the Director of Planning and Community Development (SR 96:354) <br /> regarding the request of the developer to extend the growth management <br /> allocation for Phase III of Oak Tree Farm; and <br /> <br />WHEREAS, the growth management program rules applicable to this development vests <br /> sole discretion in the City Council to extend growth management approval; <br /> and <br /> <br />WHEREAS, the City Council finds and determines that the developer has had four years <br /> to obtain a final map for this phase of the project, that other phases of this <br /> development have not progressed as rapidly as they should have, and <br /> because the PUD plan for this phase will expire if the growth management <br /> approval lapses, that a new project for this area should be evaluated. <br /> <br /> <br />
