CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 96-142 <br /> <br /> RESOLUTION DENYING THE APPEAL OF GARY <br /> SCHWAGERLE OF A DECISION OF THE PUBLIC <br /> WORKS DIRECTOR THEREBY DENYING THE <br /> REQUEST TO REMOVE A HERITAGE TREE AT 627 <br /> ROSE AVENUE <br /> <br />WHEREAS, Gary and Phoebe Schwage~e are the owners of property at 627 Rose <br /> Avenue and on that property are two Blue Green (Eucalyptus globules) <br /> trees that qualify as heritage trees under the City's Heritage Tree Ordinance <br /> (Chapter 17.16. Pleasanton Municipal Code); and <br /> <br />WHEREAS, in October 1995, the Schwagefies requested to remove one of the trees <br /> because the tree drops limbs and poses a liability issue for them; and <br /> <br />WHEREAS, the Director of Public Works denied the request of the Schwagerles to <br /> remove the heritage tree; and <br /> <br />WHEREAS, the Schwagefies appealed that decision to the City Council; and <br /> <br />WHEREAS, at its meeting of December 3, 1996, the City Council considered the report <br /> of the Public Works Director (SR 96:347) and conducted a hearing on the <br /> appeal; and <br /> <br />WHEREAS, the City Council finds and determines that the tree is not diseased and does <br /> not meet any of the other criteria for removal under the Ordinance, and that <br /> the tree has not recently been pruned in order to remove broken and dead <br /> limbs from the tree, as well as to reduce the number of multiple limbs. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The appeal of the Schwagerles is denied, thereby denying their request to <br /> remove the Heritage tree from the property at 627 Rose Avenue. <br /> <br /> <br />
