CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 96-137 <br /> <br /> RESOLUTION AUTHORIZING THE EXECUTION <br /> AND DELIVERY OF A JOINT EXERCISE OF <br /> POWERS AGREEMENT BY AND BETWEEN THE <br /> CITY OF LIVERMORE AND THE CITY OF <br /> PLEASANTON <br /> <br />WHEREAS, the City of Livermore (Livermore) and the City of Pleasanton (Pleasanton) <br /> desire to create and establish, pursuant to the laws of the State of <br /> California, the Livermore-Pleasanton Fire Department Joint Powers <br /> Authority (the Authority); and <br /> <br />WHEREAS, there has been presented to this meeting a proposed form of Joint Exercise <br /> of Powers Agreement, dated as of December 3, 1996, (the Agreement), by <br /> and between Livermore and Pleasanton, which Agreement creates and <br /> establishes the Authority; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The proposed form of Agreement, on file with the City Clerk and <br /> incorporated into this Resolution by reference, is hereby approved. The <br /> Mayor is hereby authorized to execute, and the City Clerk is hereby <br /> authorized to attest, seal and deliver, the Agreement, in substantially the <br /> form with such changes or additions thereto that may hereafter become <br /> necessary in the interests of Pleasanton, any such additions or changes to be <br /> conclusively evidenced by the execution and delivery of the Agreement. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> <br /> <br />
