CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 96-128 <br /> <br /> RESOLUTION UPHOLDING CASE AP-96-09, THE <br /> APPEAL OF A DECISION OF THE PLANNING <br /> COMMISSION'S APPROVAL OF THE APPLICATION <br /> OF EAST BAY REGIONAL PARK DISTRICT FOR A <br /> CONDITIONAL USE PERMIT <br /> <br />WHEREAS, East Bay Regional Park District has applied for a conditional use permit to <br /> operate 25 recreational vehicle campsites; and <br /> <br />WHEREAS, zoning for the property is P (Public and Institutional) District; and <br /> <br />WHEREAS, at its meeting of September 25, 1996, the Planning Commission approved <br /> the application for the conditional use permit and design review approval; <br /> and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, an appeal was <br /> filed with the City Clerk; and <br /> <br />WHEREAS, a public hearing was held before the City council on November 19, 1996, at <br /> which time all pertinent testimony and documents were reviewed; and <br /> <br /> WHEREAS, the City Council determined that the proposed use will not be compatible <br /> with the surrounding uses and properties. <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> <br /> Section 1: Upholds the appeal as filed under Case AP-96-09, thereby denying the <br /> application of East Bay Regional Park District for a conditional use permit <br /> to operate 25 recreational vehicle campsites at Shadow Cliffs Regional <br /> Park. <br /> <br /> Section 2: The City Clerk shall forward a certified copy of this resolution to the <br /> applicant with a notice that it has ninety (90) days following the date of <br /> adoption of this resolution in which to seek judicial review of this action of <br /> the City Council. <br /> <br /> <br />
