WHEN RECORDED, RETURN TO: RECORDED BY: <br /> <br /> PREANNEXATION AND PROVISION OF WATER <br /> FACILITIES AND SERVICE AGREEMENT <br /> <br /> THIS AGREEMENT is made and entered into this. day of ,1996 <br /> <br />by and between the City of Pleasanton, a municipal corporation (hereinafter referred to as "City") <br />and Donald Jackson (hereinafter referred to as "Owner"), based on the following <br /> <br />understandings: <br /> <br /> WI TNE S S E TH: <br /> <br /> WHEREAS, Owner wishes to connect to the City sewer system; and <br /> <br /> WHEREAS, generally, City policy requires annexation prior to extension of such City <br />services as water facilities; and <br /> <br /> WHEREAS, City, in accordance with State and LAFCo policies and regulations <br />regarding annexation, either cannot or is unwilling to annex small portions of neighboring areas <br />in piecemeal fashion, but may wish to annex such properties either alone or in conjunction with a <br />larger area at some future time; and <br /> <br /> WHEREAS, City policy is adequately preserved through the provisions of an agreement <br />wherein Owner consents to annexation to City at such time as City may require; and <br /> <br /> WHEREAS, City is willing to extend its sewer facilities only if there are assurances that <br />the property won't be further subdivided or developed without approval of the City. <br /> <br /> NOW, THEREFORE, City and Owner hereby agree as follows: <br /> <br /> 1. prgvision of Sewer Service. Owner may connect to City's sewer system upon <br /> execution of this Agreement prior to annexation of Owner's land.
