CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 96-122 <br /> <br /> RESOLUTION VACATING A PORTION OF JOHNSON <br /> COURT GENERALLY NORTH OF THE DENNY'S <br /> RESTAURANT PARCEL AND ADJACENT PUBLIC <br /> SERVICE EASEMENT <br /> <br />WHEREAS, at its meeting of November 5, 1996, Council reviewed the staff report <br /> (SR96:315) recommending that a portion of Johnson Court, and an <br /> adjacent public senrice easement, all as more particularly described and <br /> shown on the attached Exhibits "A-1 to A-8", be vacated; and <br /> <br />WHEREAS, this portion of Johnson Court is no longer required for street or pedestrian <br /> purposes and it dead ends into the property of a single owner (Delta <br /> Properties); and <br /> <br />WHEREAS, the adjacent public senrice easement is no longer necessary for public <br /> purposes; and <br /> <br />WHEREAS, the City owns in fee 7,334 square feet of the area to be vacated. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL. OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Pursuant to Chapter 4 of the Streets and Highways Code and based upon <br /> the findings above establishing that the right-of-way and public service <br /> easement are no longer required for street, pedestrian or other public <br /> purposes pursuant to Section 8334 of the Streets and Highways Code, the <br /> public right-of-way and public service easement described in the attached <br /> Exhibits "A-I to A-g" are hereby vacated, but reserving therefrom <br /> easements for public utility purposes in the area to be vacated, to be shown <br /> on Parcel Map 7070. <br /> <br />Section 2: The City Manager is authorized to sign a quitclaim deed conveying to Delta <br /> Properties the City's fee interest in the property described and shown in <br /> Exhibits "A-5 to A-8". <br /> <br /> <br />
