rezoning, specific plan, subdivision map, conditional use permit, building permit or <br /> any other discretionary entitlement, which is inconsistent with this initiative. <br /> <br /> C. General Plan Reorganization. The General Plan may be reorganized, and <br /> individual provisions may be tenumbered or reordered in the course of ongoing <br /> updates of the General Plan in accordance with the requirements of state law, but <br /> Land Use Policy 11 and Programs 11.1 through 11.5 shall continue to be included <br /> in the General Plan unless repealed or amended pursuant to the procedures set <br /> forth above or by the voters of the City. <br /> <br /> D. Takings. The City Council may amend the UGB if it makes each of the following <br /> findings: <br /> <br /> (1) That an application for an amendment to the Urban Growth <br /> Boundary has been rejected by the voters of the City of Pleasanton; <br /> <br /> (2) That following the rejection of the proposed amendment to the <br /> Urban Growth Boundary the final judgment of a court of competent <br /> jurisdiction concludes that the application of any aspect of Land <br /> Use Policy 11 and programs 11.1 through 11.4 would constitute an <br /> unconstitutional taking of a landowner's property; and <br /> <br /> (3) That the amendment and associated land use designation will allow <br /> additional land uses only to the minimum extent necessary to avoid <br /> the unconstitutional taking of the landowner's property. <br /> <br />Section 7. Exemptions for Certain Proiects <br /> <br />This initiative shall not apply to any development project that has obtained as of the effective date <br />of the initiative a vested right pursuant to state law. <br /> <br />Section 8. Severability <br /> <br />If any portion of this initiative is hereafter declared invalid by a court of competent jurisdiction, all <br />remaining portions are to be considered valid and shall remain in full force and effect. <br /> <br />Section 9.
