C. General Plan Reorganization. The General Plan may be reorganized, and <br /> individual provisions may be tenumbered or reordered in the course of ongoing <br /> updates of the General Plan in accordance with the requirements of state law, but <br /> Land Use Policy 15 and Programs 15.1 through 15.2 shall continue to be included <br /> in the General Plan unless repealed or amended pursuant to the procedures set <br /> forth above or by the voters of the City. <br /> <br /> D. Takings. The City Council may amend the policy and/or programs adopted by <br /> this initiative if it makes each of the following findings: <br /> <br /> (1) That an application for an amendment to the policy and/or <br /> programs adopted by this initiative has been rejected by the voters <br /> of the City of Pleasanton; <br /> <br /> (2) That following the rejection of the proposed amendment to the <br /> policy and/or programs adopted by this initiative, the final judgment <br /> of a court of competent jurisdiction concludes that the application <br /> of any aspect of that policy and/or programs would constitute an <br /> unconstitutional taking of a landowner's property; and <br /> <br /> (3) That the amendment will allow additional residential development <br /> only to the minimum extent necessary to avoid the unconstitutional <br /> taking of the landowner's property. <br /> <br />Section 5. Exemptions for Certain Proiects <br /> <br />This initiative shall not apply to any development project that has obtained as of the effective date <br />of the initiative a vested right pursuant to state law. <br /> <br />Section 6. Severability <br /> <br />If any portion of this initiative is hereafter declared invalid by a court of competent jurisdiction, all <br />remaining portions are to be considered valid and shall remain in full force and effect. <br /> <br />Section 7.
