CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 96-36 <br /> <br /> RESOLUTION DIRECTING LAVWMA REPRESENT- <br /> ATIVES TO DISAPPROVE TRANSMITTAL TO EBDA <br /> OF THE CONDITIONS IN THE DSRSD PROPOSAL <br /> <br />WHEREAS, the Livermore-Amador Valley Water Management Agency (LAVWMA) <br /> received from the East Bay Dischargers Authority (EBDA) a revised formal <br /> offer dated January 25, 1996, to provide 11.42 million gallons per day of <br /> additional capacity for average dry weather flow (ADWF) in EBDA's <br /> system; and <br /> <br />WHEREAS, at its meeting of April 3, 1996, the LAVWMA Board of Directors voted 4-2 <br /> in favor of accepting the EBDA offer subject to certain minor <br /> modifications; at the same meeting, the LAVWMA Board of Directors <br /> voted 2-4 concerning a proposal advanced by the Dublin San Ramon <br /> Services District (DSRSD) for acceptance of the EBDA offer subject to <br /> conditions which differ from those approved by the majority of the <br /> LAVWMA Board of Directors; and <br /> <br />WHEREAS, the City of Livermore proposed certain changes to the proposal for <br /> acceptance of the EBDA offer, as set forth in Attachment #1 to this <br /> resolution; and <br /> <br />WHEREAS, the City Council finds and determines that the DSRSD proposal rejected by <br /> the LAVWMA Board of Directors on April 3, 1996, is incompatible with <br /> the proposal approved by the Board of Directors on April 3, 1996, and with <br /> the proposed changes set forth in Attachment # 1. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The Pleasanton City Council directs the Councilmembers who are <br /> LAVWMA representatives to disapprove transmitting to EBDA the DSRSD <br /> proposal rejected by the LAVWMA Board of Directors at its April 3, 1996 <br /> meeting. <br /> <br /> <br />
