CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 96-22 <br /> <br /> RESOLUTION APPROVING THE ARROYO MOCHO <br /> BIKEWAY PROJECT AND AUTHORIZING <br /> SUBMITTAL OF CLAIM <br /> <br />WHEREAS, the Metropolitan Transportation Commission (MTC) requires a resolution <br /> of support for Transportation Development Act (TDA) applications; and <br /> <br />WHEREAS, the Arroyo Mocho Bikeway will assist the pedestrian and bicycle travel; <br /> and <br /> <br />WHEREAS, City staff, together with bicycle advisory committee members have <br /> reviewed various projects, and <br /> <br />WHEREAS, this project is categorically exempt under the requirements of CEQA; and <br /> <br />WHEREAS, Pleasanton's legal counsel has determined: a) that the claimant is <br /> authorized to perform the project for which the funds are claimed; b) that <br /> the claimant is eligible to claim under Public Utilities Code Section 99234; <br /> and c) that there is no legal impediment to the claimant applying for ~mds <br /> or there is no pending or threatened litigation that might adversely affect the <br /> project or the ability of the claimant to carry out the project. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br /> Section 1: The Pleasanton City Council authorizes submittal of the project application <br /> and subsequent submittal of claims for payment. <br /> <br />Section 2: This resolution shah become effective immediately upon its passage and <br /> adoption. <br /> <br /> <br />
