CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 96-06 <br /> <br /> RESOLUTION DENYING ~ APPEAL OF A <br /> DECISION OF THE PLANNING COMMISSION AND <br /> APPROVING THE APPLICATION OF STEVEN <br /> SLIPKA FOR A CONDITIONAL USE PERMIT FOR A <br /> SECONDARY UNIT AT 4074 SUFFOLK WAY, AS <br /> FILED UNDER CASE UP-95-51 <br /> <br />WHEREAS, Steven Slipka, the owner of the property at 4074 Suffolk Way, applied to <br /> the City for an after the fact conditional use permit for a secondary unit <br /> within the single-family residence located at that property; and <br /> <br />WHEREAS, zoning for the property is R-1-6,500 (single-family residential) District; and <br /> <br />WHEREAS, at its meeting of November 8, 1995, the Planning Commission approved the <br /> application for the conditional use permit; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, an appeal was <br /> fled with the City Clerk; and <br /> <br />WHEREAS, a public hearing was held before the City Council on January 2, 1996, at <br /> which time all pertinent testimony and documents were reviewed; and <br /> <br />WHEREAS, after a review of the material presented, the City Council makes the <br /> following findings: <br /> <br /> a. The proposed location of the conditional use is in accordance with <br /> the objectives of the zoning ordinance and the purpose of the district in <br /> which the site is located. <br /> <br /> b. The proposed location of the conditional use and the conditions <br /> under which it would be operated or maintained will not be detrimental to <br /> the public health, safety, or welfare, or materially injurious to the properties <br /> or improvements in the vicinity. <br /> <br /> c. The proposed conditional use will comply with Ti~e 18 of the <br /> Pleasanton Municipal Code. <br /> <br /> <br />
