CITY COUNCIL OF THE CITY OF PLEASANTON <br /> As Board of Directors of the Laurel Creek Estates <br /> Geologic Hazard Abatement District <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> RESOLUTION NO. 99-004 <br /> <br /> RESOLUTION CONFIRMING ASSESSMENT FOR LAUREL <br /> CREEK ESTATES GEOLOGIC HAZARD ABATEMENT <br /> DISTRICT AND ORDERING LEVY AND COLLECTION <br /> THEREOF <br /> <br />WHEREAS, on November 18, 1997, the City Council adopted Resolution No. 97-135, <br /> approving the formation of a Geologic Hazard Abatement District CGHAD") for <br /> the Laurel Creek Estates area and appointing the City Council as the initial Board <br /> of Directors for the GHAD; and <br /> <br />WHEREAS, in order to defray the costs and expenses of maintaining and operating the GHAD <br /> improvements, it will be necessary to provide for a reliable source of GHAD <br /> funding; and <br /> <br />WHERE-AS, Public Resources Code Sections 26650 et seq. authorize, after a noticed public <br /> hearing, the levy and collection of an assessment upon benefited property within <br /> the GHAD to pay for the maintenance and operation of GHAD improvements and <br /> Article XIII D of the California Constitution imposes additiona.'- requirements for <br /> the levy and collection of the assessment; and <br /> <br /> WHEREAS, on December 1, 1998, pursuant to both public Resources Code Sections 26650 et <br /> seq. and Article XIII D of the California Constitution, the Board adopted a <br /> Resolution of Intention to Order an Assessment for the Laurel Creek Estates <br /> Geologic Hazard Abatement District and setting a public hearing to consider all <br /> protests against said assessment, Resolution No. 98-15 1; and <br /> <br /> WHEREAS, Resolution No. 98-151 declared the Board's intention, consistent with the <br /> requirements of Article XIII D of the California Constitution, to order that the <br /> costs and expenses of the GHAD improvements be assessed against the property' <br /> within the GHAD which is benefited by the GHAD; and <br /> <br /> <br />
