CITY COUNCIL OF THE CITY OF PLEASANTON As Board of Directors of the Laurel Creek Estates Geologic Hazard Abatement District ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 99-004 RESOLUTION CONFIRMING ASSESSMENT FOR LAUREL CREEK ESTATES GEOLOGIC HAZARD ABATEMENT DISTRICT AND ORDERING LEVY AND COLLECTION THEREOF WHEREAS, on November 18, 1997, the City Council adopted Resolution No. 97-135, approving the formation of a Geologic Hazard Abatement District CGHAD") for the Laurel Creek Estates area and appointing the City Council as the initial Board of Directors for the GHAD; and WHEREAS, in order to defray the costs and expenses of maintaining and operating the GHAD improvements, it will be necessary to provide for a reliable source of GHAD funding; and WHERE-AS, Public Resources Code Sections 26650 et seq. authorize, after a noticed public hearing, the levy and collection of an assessment upon benefited property within the GHAD to pay for the maintenance and operation of GHAD improvements and Article XIII D of the California Constitution imposes additiona.'- requirements for the levy and collection of the assessment; and WHEREAS, on December 1, 1998, pursuant to both public Resources Code Sections 26650 et seq. and Article XIII D of the California Constitution, the Board adopted a Resolution of Intention to Order an Assessment for the Laurel Creek Estates Geologic Hazard Abatement District and setting a public hearing to consider all protests against said assessment, Resolution No. 98-15 1; and WHEREAS, Resolution No. 98-151 declared the Board's intention, consistent with the requirements of Article XIII D of the California Constitution, to order that the costs and expenses of the GHAD improvements be assessed against the property' within the GHAD which is benefited by the GHAD; and
