CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 98-161 <br /> <br /> RESOLUTION ESTABLISHING A NORTH SYCAMORE <br /> AREA DEVELOPMENT IMPACT FEE FOR BASIC <br /> INFRASTRUCTURE IMPROVEMENTS WITHIN THE <br /> TERRITORY ENCOMPASSED BY THE CITY OF <br /> PLEASANTON NORTH SYCAMORE SPECIFIC PLAN AND <br /> CERTAIN OTHER AREAS <br /> <br />WHEREAS, the Council of the City of Pleasanton adopted Ordinance No. 1772 creating and <br /> establishing the authority for imposing and charging a Noah Sycamore Area <br /> Development Impact Fee ("Area Development Impact Fee"), applicable to new <br /> development situated within the geographic area of the City's Noah Sycamore <br /> Specific Plan ("Noah Sycamore Specific Plan Area") and certain other areas; and <br /> <br />WHEREAS, the repoa prepared by Economic and Planning Systems, Inc. entitled <br /> "Infrastructure Financing Plan and Technical Repoa for the Noah Sycamore <br /> Specific Plan," dated December 1,1998, ("Technical Repoa") which is on file with <br /> the Depaament of Planning and Community Development and the City Clerk, <br /> included a basic infrastructure program and identified the need for, and calculated <br /> the amount of, a development impact fee in the Noah Sycamore Specific Plan <br /> Area and ceaain other areas to pay for the construction of the basic public <br /> infrastructure facilities set foah in the Basic Infrastructure Program as defined in <br /> Ordinance No. 1772, which are needed to serve new development in the Noah <br /> Sycamore Specific Plan Area and ceaain other areas; and <br /> <br />WHEREAS, the City Council has considered the Technical Report and its appendices, the EIR <br /> for the City's Noah Sycamore Specific Plan, the adopted Noah Sycamore Specific <br /> Plan, the City's General Plan, the Conceptual Plan and PUD approval granted by <br /> the City Council to the initial Funding Developer on February 17, 1998, and the <br /> repoas (oral and written) of staff and the City's consultant; and <br /> <br />WHEREAS, a duly noticed public meeting was held on December 1, 1998 by the City Council, <br /> at which public comments, oral and written on the proposed Noah Sycamore Area <br /> Development Impact Fee and its associated matters were received and have been <br /> considered; and, <br /> <br /> <br />
