CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 98-158 RESOLUTION APPROVING A MITIGATED NEGATIVE DECLARATION FOR THE APPLICATION OF MERRITT/SCHOLES (DE SILVA/GATES), AS FILED UNDER CASE PUD-96-14 WHEREAS, at its meeting of December 1, 1998, the City Council received a proposed mitigated negative declaration for the application of Merritt/Scholes (DeSilva/Gates) for Planned Unit Development prezoning and development plan approval for 91 single-family homes (including three existing homes) on 46.4 acres located at 413 1 and 4141 Foothill Road; and WHEREAS, the City Council received and reviewed the Initial Study dated July 1, 1998, and received the recommendations of the staff and Planning Commission; and WHEREAS, a duly noticed public hearing was held at which time the public was given the opportunity to comment on the environmental impacts of the proposed project; and WHEREAS, the City Council has reviewed the potential impacts in accordance with the applicable state and local guidelines governing the preparation of Mitigated Negative Declarations and Environmental Impact Reports; and WHEREAS, the City Council finds that based upon the review of the Initial Study and the testimony and documentary evidence presented at the public hearing that there may be significant impacts on the environment, but that the developer has agreed to mitigation measures to render these potential impacts insignificant; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Approves the Mitigated Negative Declaration for the application of Merritt/Scholes (DeSilva/Gates) for Planned Unit Development prezoning and development plan approval for 89 single-family homes (including three existing homes) on 46.4 acres located at 413 1 and 4141 Foothill Road.
