CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 98-158 <br /> <br /> RESOLUTION APPROVING A MITIGATED NEGATIVE <br /> DECLARATION FOR THE APPLICATION OF <br /> MERRITT/SCHOLES (DE SILVA/GATES), AS FILED <br /> UNDER CASE PUD-96-14 <br /> <br />WHEREAS, at its meeting of December 1, 1998, the City Council received a proposed <br /> mitigated negative declaration for the application of Merritt/Scholes <br /> (DeSilva/Gates) for Planned Unit Development prezoning and development plan <br /> approval for 91 single-family homes (including three existing homes) on 46.4 <br /> acres located at 413 1 and 4141 Foothill Road; and <br /> <br />WHEREAS, the City Council received and reviewed the Initial Study dated July 1, 1998, and <br /> received the recommendations of the staff and Planning Commission; and <br /> <br />WHEREAS, a duly noticed public hearing was held at which time the public was given the <br /> opportunity to comment on the environmental impacts of the proposed project; and <br /> <br />WHEREAS, the City Council has reviewed the potential impacts in accordance with the <br /> applicable state and local guidelines governing the preparation of Mitigated <br /> Negative Declarations and Environmental Impact Reports; and <br /> <br />WHEREAS, the City Council finds that based upon the review of the Initial Study and the <br /> testimony and documentary evidence presented at the public hearing that there <br /> may be significant impacts on the environment, but that the developer has agreed <br /> to mitigation measures to render these potential impacts insignificant; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Approves the Mitigated Negative Declaration for the application of <br /> Merritt/Scholes (DeSilva/Gates) for Planned Unit Development prezoning and <br /> development plan approval for 89 single-family homes (including three existing <br /> homes) on 46.4 acres located at 413 1 and 4141 Foothill Road. <br /> <br /> <br />
