Resolution No. 98-151 <br />Page Three <br /> <br />Section 6: No later than December 2, 1998, the Board directs the GHAD Clerk to mail the <br /> "Notice of Adoption of Resolution" of the Public Hearing, attached as Exhibit C, <br /> to the record owners of each parcel upon which the assessment will be imposed. <br /> The Ballot, attached as Exhibit D, and the Engineer's Report shall be attached to <br /> the Notice. <br /> <br />Section 7: The Board will conduct the Public Hearing on January 19, 1999 at 6:55 p.m. in the <br /> City Council Chambers, 200 Old Bemal Avenue, Pleasanton, Califomia. The <br /> Clerk shall deliver all the Ballots received fi'om record owners of parcels within <br /> the GHAD boundaries to the Board prior to the start of the Public Hearing. The <br /> Board shall permit a change, withdrawal, or submittal of a Ballot at any time prior <br /> to the conclusion of the public testimony on the proposed assessment at the public <br /> hearing. The Board shall then consider all protests against the proposed <br /> assessment and tabulate the Ballots. In tabulating the Ballots, the Board shall <br /> weight the Ballots according to the proportional financial obligation of the affected <br /> property. The Board shall not impose. the assessment if there is a majority protest <br /> as that term is defined by Section 4(e) of Article XIII D of the California <br /> Constitution. If there is no majority protest, the Board shall authorize the <br /> assessment. <br /> <br />Section 8: The Board shall levy the authorized assessment on each parcel at the time the City <br /> formally accepts the public improvements in the Laurel Creek Estates <br /> development. <br /> <br />Section 9: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AS <br />BOARD OF DIRECTORS OF THE LAUREL CREEK ESTATES GEOLOGIC HAZARD <br />ABATEMENT DISTRICT, AT A MEETING HELD ON DECEMBER 1, 1998 BY THE <br />FOLLOWING VOTE: <br /> <br /> <br />
