CITY COUNCIL OF THE CITY OF PLEASANTON <br /> as Board of Directors of Laurel Creek Estates <br /> Geologic Hazard Abatement District <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> RESOLUTION NO. 98-151 <br /> <br /> RESOLUTION OF INTENTION TO ORDER AN <br /> ASSESSMENT FOR THE LAUREL CREEK ESTATES <br /> GEOLOGIC HAZARD ABATEMENT DISTRICT AND <br /> SETTING A PUBLIC HEARING TO CONSIDER PROTESTS <br /> AGAINST SAID ASSESSMENT <br /> <br />WHEREAS, on November 18, 1997, the City Council of the City of Pleasanton adopted <br /> Resolution No. 97-135, approving the formation of a Geologic Hazard Abatement <br /> District CGHAD") for the Laurel Creek Estates area and appointing the City <br /> Council as the Board of Directors of the GHAD; and <br /> <br />WHEREAS, in order to defray the costs and expenses of maintaining and operating the GHAD <br /> improvements, it will be necessary to provide for a reliable source of GHAD <br /> funding; and <br /> <br />WHEREAS, Public Resources Code Sections 26650 et seq. authorize, after a noticed public <br /> hearing, the levy and collection of an assessment upon benefited property within <br /> the GHAD to pay for the maintenance and operation of GHAD improvements; <br /> Article XIII D of the Califomia Constitution imposes additional requirements for <br /> the levy and collection of the assessment; and <br /> <br />WHEREAS, the property within the GHAD is identified in the map attached as Exhibit A, and <br /> each parcel to be assessed is identified by assessor's parcel number, if available; <br /> and <br /> <br />WHEREAS, an Engineer's Report has been prepared by the GHAD Geologist/General Manager <br /> and a registered professional engineer, certified in the State of California, in <br /> compliance with Public Resources Code Section 26651 (a) and with Section 4(b) of <br /> Article XIII D of the California Constitution. The Engineer's Report, attached as <br /> Exhibit B, sets forth the purpose of the GHAD, the estimated budget, the total <br /> assessment that will be chargeable to the entire GHAD, the proposed estimated <br /> assessment to be levied against each parcel of property within the GHAD, and a <br /> description of the method used in formulating the estimated assessments; and <br /> <br /> <br />
