CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 98-131 <br /> <br /> RESOLUTION CERTIFYING THAT CITY ASSESSMENTS <br /> COMPLY WITH PROPOSITION 218 <br /> <br />WHEREAS, every year cities (and some special districts) throughout Alameda County request <br /> the County to place on upcoming property tax bills taxes and assessments that the <br /> cities and the special districts have levied; and <br /> <br />WHEREAS, because of Proposition 218 concerns, the County Auditor requested the requesting <br /> agencies (1) to certify that the taxes and assessments that were to be placed on the <br /> 1998/99 tax bill meet the requirements of Proposition 218, and (2) to indemnify <br /> the County should there be a challenge to the tax or assessment on grounds that it <br /> doesn't comply with the requirements of Proposition 218; and <br /> <br />WHEREAS, because City staff has discussed these various assessments at length with the City <br /> Council in context of Proposition 218 and because the Council has taken action to <br /> continue to levy these various assessments, the City is satisfied that the <br /> assessments that it has requested the County to place on the 1998/99 tax rolls meet <br /> the requirements of Proposition 218. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Council certifies to the County of Alameda that the assessments that the <br /> City requested the County to place on the 1998/99 tax roll meet the requirements <br /> of Proposition 218 and that the City Attorney is authorized to sign the attached <br /> Certification and Indemnification Agreement. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> <br />
